  • Alleged drug dealer charged in Kiowa County

  • Harrison Fleener made his first appearance before Judge Ann Dixson in Kiowa County District Court Friday, Feb. 28, where he was alleged by Kiowa County Attorney J. Scott James to have committed seven different drug related offenses. The charges resulted from information obtained by investigations by the Kiowa County Sheriff’s Department and others and a search warrant served on Fleener’s place of residence.
     All of the alleged offenses were committed between December 10-20 of 2013:
    • Count 1 - Distribution of marijuana less than 25 grams - between December 10-11, 2013 - a drug severity level 4 nonperson felony.
    • Count 2 - Distribution of marijuana less than 25 grams - on, or about, December 20, 2013 - a drug severity level 4 nonperson felony.
    • Count 3 - Attempted distribution of marijuana less than 25 grams - on, or about, December 19, 2013 - a drug severity level 4 nonperson fe;felon.
    • Count 4 - Using a communication facility in drug dealing - on, or about, December 10, 2013 - a drug severity level 8 nonperson felony.
    • Count 5 - Using a communication facility in drug dealing - on, or about, December 19, 2013 - a drug severity level 8 nonperson felony.
    • Count 6 - Possession of marijuana without a tax stamp attached - on, or about, December 10, 2013 - a drug severity level 10 nonperson felony.
    • Count 7 - Possession of marijuana without a tax stamp attached - on, or about, December 20, 2013 - a drug severity level 10 nonperson felony.
    As a result of the appearance probable cause was found for his arrest and detention.
    Fleener asked for a court appointed representative. After reviewing his financial affidavit the court appointed Sally Shattuck as his counsel.
    Fleener is to pay an application fee of $100 as a condition of bond, or in any event within 30 days.
    Fleener’s bond was set at $100,000 cash, or insured cash, with the following conditions applying:
    • Don’t possess or consume alcohol or illegal drugs,
    • Submit to random testing of blood, breath, or urine at request of the court/Court Services/law enforcement,
    • Do not leave the state of Kansas,
    • Report to Court Services on Mondays every week while on bond,
    • Do not associate with other persons on supervision for bond, or probation.
    Fleener currently remains in Kiowa County Jail. His next appearance is scheduled for 1:30 p.m., March 11, 2014. He has other charges to be answered to in Pratt County District Court.
    He should be considered innocent until proven guilty.
